Dear Sir:

Our Desaria neighborhood in Sg. Ara had a big scare Saturday March 24th, when a massive stone boulder came crashing down onto the street near our home. It was simple luck that no one was killed or injured. The developer, Palmex, is building new homes on top of the hill above our street and due the their negligence and the severe steepness of the hill, our lives were placed at risk. When contacted, the Palmex GM Mr. Ang said simply that it was ‘just an accident’. When contacted again on March 26, 2007, after being given an email with photos of the boulder, his response was that nothing needed to be done. I suppose it was ‘just an accident’ when a similar sized boulder crashed down from the Regency Heights Condominium construction site also in Desaria last year, which is also built by Palmex. That time we did not report it, but this time someone could have died and I’m requesting the appropriate authorities to halt Palmex from further work until our safety concerns are addressed. Boulders sliding off construction sites are not accidents. They are completely preventable if the construction is done in a professional manner.

I hope the authorities will take action before someone is killed or injured.

You have done a good job for the welfares of residents in your area.

You have portrayed a good photo scenario of risks to the by-passing people, the pedestrians, the commuters and if these factors are still not enough to stir the attention and due action to be taken by MPPP. You should lead a team to Ir Khoo's office for a justified explanation ! This is time the Council should proof their proper diligence instead of going round Penang Road shops and act like thugs!

Bad Service From Palmex

I am new resident from Regency Heights Condominium Sg. Ara.  Nowadays that's very bad service we received from this developer!  Why I say that?  because I can't move in to this new condo due to I don't let Palmex appointed contractor to renovate my condo! This is something we call licensed samseng!  The charges from their deleloper very expesive from outside market!  Please consider if your want to buy house from Palmex Industries Sdn. Bhd. and somemore they are under IOI Group!

Why we pay the security if they can't stop this licensed sams...

I wonder why we must pay the monthly service charge; including paying the securities service if they can't stop this licensed samseng (not a resident) from trespassing to the condo compound. This is something controllable if the securities do their job properly.

Hi, I'm also the new resident from Regency Ht, about the renovation, I guess there must be some miscommunication? You can call Palmex and check perhaps as I am also engage my own renovator to do it now as agreed so by Palmex.

Trust the CPO of Penang....

Based on my experience, the most effective way to stop all the thugs to monopolize the renovation works at your area is to report direct to the CPO and CC to Bukit Aman in case the CPO has neglected your complaint.

The "Samseng" are actually supported by the developer to cari makan there and they are gangster turned contractor and act as middle man to get jobs and sub-contract to the real contractors who will do the job for you! That's why the price is very expensive compare with outside market!

This is a very bad culture ever exist in Penang for long enough and we should take up actions against them! Don't simply trust the normal policemen as some of them are working with the samseng as their godfathers! It happened at Jln. Perak where samseng there used the name of OCPD as their boss !

So go direct to the CPO, he is one we can trust !

Renovation Waste Collection = RM450

why would palmex authorize thugs to collect RM450 for clearing renovation waste? It seems that these thugs would harass the the renovator to pay up & eventually the money is pass to the owner by marking up the renovation price. If the renovator refuses to pay the amount, these thugs will get the money from the management and as a result the owner will not get back their renovation deposit.1 unit = RM450.00, 500units the thugs will easily earn over RM200,000-00. Besides the waste steel will also earn them more $$$ since now steels are in great demand.  How come the management is collaborating with them if we refuse to pay up? Yes, as owner I want Regency heights to be clean and it is the renovator duty to clear the wastage. If the owner’s renovator does not clear up the wastage then there is logical reason for the management not to return the deposit. The current scenario is you have no choice but to pay them. Who appointed them to be sole & exclusive to collect wastage? Why our own renovator cannot clear the wastage? Are there any hanky panky going on between the management & the thugs in splitting the collection from owners’ hard earn money.

Developer or robber ?!

In normal practice, any apartment owner who wishes to renovate his unit will have to pay to the management corporation or developer a renovation deposit, which amount varies according to the respective management in-charge. The average tariff of 500.00 is commonly levied for such deposit. And the renovation deposit is refundable subject to the conditions that all debris or remains of building materials will have to be cleared, cart away from the compound / common property; also the renovation contractors must ensure that they do not damage any of the services such as lifts, in particular, or else they will cause the Unit Owner to lose his deposit since the management corp. has the rights to forfeit, use part or whole of d deposit to defray the costs of repair etc.

There is no law specifically mentioned in the SnP agreement for such item and it is merely a common practice, hitheto becomes a common law being applied by most of the Developer and/or Management Corporation. This, in my opinion, is effective way to ensure that the contractors engaged by the unit owners are responsible ones who will take care of the public's property. Failing which they will be fined or penalized!

For the case you mentioned, I think d RM450.00 was a fee charged to undertake clearance of garbage, debris etc. from the site by the "thugs" authorized by the Developer. It happened as well in some other area with particular impression to me that Sg. Ara is among one of the most notorious area for those kind of incidents!

RM450.00 just to cart away debris? How many lorry load of volumn? I do feel that it is rather costly to charge such exorbitant amount!

As the unit owner, you have all the rights to refuse their service and engage your own workers to do the job. The developer has no rights whatsoever to force you into letting his authorized gang to monopolize the renovation works! By doing so, they have violated the laws and you can file a report with the police and they can be charged under the Police Act!

Again, I will advise all those victims who have been harassed by the gangsters to seek help from the CPO, other than report to the police station! Appeal to Bukit Aman if no action is being taken!

Hi folks, Its good that we discuss and expose the activities of the thugs. I was told of the RM450 arrangement by the management office too and i am quite concerned to engage my own contractor who can provide better service and much cheaper price.
